The agreement

These terms are an agreement between you and Astel ([Legal entity name], [Registered address]), the makers of Gulp. By creating an account or using Gulp, you agree to them and to our privacy policy. If you don't agree, please don't use Gulp.

Who can use Gulp

If you are under the age of majority where you live, you may only use Gulp with the permission of a parent or guardian, who agrees to these terms for you. [Review once the age decision is made.]

Your account

You sign in to Gulp with Apple or Google. Please keep that account secure, because anything done through it on Gulp is treated as done by you. Choose a display name that isn't offensive and doesn't pretend to be someone else. Tell us at hello@astelapps.com if you think someone else is using your account.

Squads and being kind

Squads are for friends drinking water together. Splashes are meant as playful nudges, never as pressure. When you use Gulp, please don't:

• harass, bully or shame anyone, including through display names, squad names or repeated splashes;
• pretend to be someone else, or share invite links in ways meant to spam people;
• cheat the counting, for example with scripts, modified apps or false logs meant to farm drops or rank;
• try to break, overload, reverse engineer or get around the security of Gulp, except where the law allows;
• use Gulp for anything unlawful.

A squad's owner can remove members, and we may remove names, squads or accounts that break these rules. You keep any rights you have in the names you create, and you let us display them in Gulp so your squad can see them.

Health

Gulp is a habit app for fun and motivation. It is not a medical device and it does not give medical advice. Goals and reminders are not recommendations for how much you personally should drink. Talk to a doctor about your fluid needs, especially if you're pregnant, have a health condition, or have been told to limit fluids. Gulp never rewards drinking past your goal or drinking fast, and you should never drink more than is comfortable to keep a streak or fill a lake.

Drops and Kit items

Drops are a virtual currency you earn in Gulp or buy in packs, and Kit items are virtual looks for your mascot. They are a limited, personal license to use inside Gulp. They have no cash value, can't be exchanged for money, sold or transferred (except as gifts inside Gulp where the app offers it), and aren't refundable except where the law or the store's refund policy says otherwise. Some items unlock only with a streak and can't be bought. We may adjust prices, rewards and items, and if Gulp ever shuts down, we'll give reasonable notice. Purchases and subscriptions

All purchases in Gulp (Gulp+, the Squad Pass and drop packs) are made through the Apple App Store or Google Play and are also covered by their terms. Prices are shown in the app before you buy.

• Gulp+ is a subscription that renews automatically each month or year until you cancel. If a free trial is offered, you're charged when it ends unless you cancel at least 24 hours before.
• A Squad Pass is bought by one member for a whole squad and renews yearly until cancelled. Its benefits apply to that squad's members while the pass is active.
• You manage and cancel subscriptions in your App Store or Google Play account. Deleting the app or your Gulp account doesn't cancel them.
• Refunds are handled by Apple or Google under their policies. If a purchase is refunded, we remove what it gave you, such as purchased drops.
• Items from a monthly kit drop are yours to keep after you cancel. Other Gulp+ benefits end with the subscription period.

Nothing you pay for adds gulps, lake, streak days or rank.

Notifications

With your permission, Gulp sends reminders and squad notifications, such as when a friend splashes you. You can turn each kind off in the app's settings or in your phone's settings.

Our app and art

Gulp, its mascots, art, animations, names and software belong to Astel and are protected by law. We give you a personal, non-exclusive, non-transferable license to use the app for your own use under these terms. If you send us ideas or feedback, we may use them without owing you anything.

Ending your account

You can stop using Gulp at any time and delete your account in the app under Me, then Delete account. We may suspend or close accounts that seriously or repeatedly break these terms, and we'll explain why where we can. When an account is closed, its drops and items go with it.

Warranties and liability

We work hard to keep Gulp running well, but it's provided "as is", without warranties beyond those the law requires. To the extent the law allows, Astel isn't liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the 12 months before it. Nothing in these terms limits rights you have as a consumer that can't be limited by contract. [Review: liability caps and consumer rights wording for each launch market.]

App store terms

If you downloaded Gulp from the Apple App Store, you and we agree that these terms are between you and Astel only, not Apple. Apple isn't responsible for Gulp or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to Gulp, including product liability, legal compliance or intellectual property claims. If Gulp fails to meet a warranty, you may tell Apple and Apple will refund the purchase price, if any, and has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you aren't in a country under a US government embargo and aren't on a US list of prohibited or restricted parties. If you downloaded Gulp from Google Play, Google Play's terms also apply.

Law, changes and contact

These terms are governed by [Governing law and venue]. If we change them in a way that matters, we'll tell you in the app before the change takes effect, and if you keep using Gulp after that, the new terms apply. Questions are welcome at hello@astelapps.com.
